A Texas high school student has filed a federal lawsuit against her school and her teachers after she was punished for refusing to salute and recite the Mexican pledge of allegiance.

The Thomas More Law Center filed the suit on behalf of Brenda Brinsdon alleging the McAllen Independent School District violated the 15-year-old girl’s constitutional rights when she was forced to recite the Mexican pledge and sing the Mexican national anthem.

Brinsdon, who is the daughter of a Mexican immigrant and an American father, refused. She believed it was un-American to pledge a loyalty oath to another country.

Ironically, the school district has a policy that prohibits a school from compelling students to recite the American Pledge of Allegiance.

The district also has a written policy that excuses students from reciting text from the Declaration of Independence if the student “as determined by the district, has a conscientious objection to the recitation.”

“There is a sad trend in public schools across our nation to undermine American patriotism,” said Richard Thompson president of the Thomas More Law Center. “But it’s encouraging to see students like Brenda stand up for America despite pressure from school officials.”

The TMLC told Fox News the district ignored its own rules when Brinsdon refused to recite the pledge of a foreign country.

What’s most troubling is the different treatment for someone wanting to opt out of reciting the American Pledge of Allegiance compared to someone as a matter of conscience wants to opt out of reciting the Mexican pledge,” spokesman Erin Mersino told Fox News.

A spokesman for the McAllen Independent School District told Fox News they had not seen a copy of the lawsuit.

The recitation of the Mexican pledge and the singing of the Mexican national anthem was part of a 2011 Spanish class assignment at Achieve Early College High School.  The teacher, Reyna Santos, required all her students to participate in the lesson.

When Brinsdon refused to back down – she was punished, the lawsuit alleges. She was given an alternative assignment on the Independence of Mexico. The teacher gave her a failing grade – and then required the student to sit in class over a period of several days to listen to other students recite the Mexican pledge.

The lawsuit states Brinsdon offered to recite the American pledge in Spanish but the teacher refused her request.

“It’s astonishing that this Texas school would deny Brenda her right of conscience and free speech not to pledge allegiance to a foreign country,” said Thompson. “Too many Americans – including those of Mexican descent – have suffered and died protecting our nation.”

And while she is fluent in Spanish and English and is proud of her Mexican heritage, Brinsdon is a “true-blooded American,” Mersino added.

Mersino said it was especially troubling to watch video of students in the class standing up, extending their arms straight out, palms down and reciting the pledge of a foreign country.

“It’s disturbing – it truly was troubling,” she said.

  2. Do you guys know that here in Yuma, AZ that they send school buses over into Mexico everyday to pick up Mexican kids and bring them to school over here in the Yuma School District. Whaaaaaaat, are you serious???

    Also, there has always been guys I worked with doing construction, who live in Mexico, and everyday cross the border legally to come and work on our crew. They work so cheap now, that I am making less now per hour then I did 35 years ago.

    I can’t even make enough to support my family here in the states, but, they can work here and make way more than the cost of living in their country of Mexico. They own homes and brand new trucks. They live good.

    I have asked them here and there, if they are taught in Mexico growing up that Calif, Ariz, New Mexico, and Texas really belong to them? and that is there a plan of “Reconquesta” of those states. They always put their heads down and say like under their breath… “Yes, that is what we are taught from the time we a little ones”.

    We had all better wake up! You all know what has to happen to fix all of this!!!

  4. All school officials should be fired, stripped of their citizenship and deported from the US. This constitutes treason if they are pledging allegiance to a foreign nation. In fact to gain citizenship in many countries you must renounce your US citizenship and pledge allegiance to theirs. I don’t see how this is any different.

    1. Citizen’s Arrest….at the very least. With force if, unfortunately, necessary.
      If the citizens of that area do not do that, at the very least, then nothing is really going to change. Although bringing it to light is a very good thing..IMO, no bitching about it, saying “hey that’s wrong, please don’t do that anymore”, ‘presenting’ it to the just-as-brainwashed court system, etc., doesn’t mean a damn thing at this point. But ‘forcing’ it upon the courts might make a difference for a while….but it is still a distraction from the bigger picture that needs taken care of.

      your words were not very far from my first thought. But then I thought of a reasonable alternative to get the message through with absolute minimal danger to any children or innocents attending.

      This incident at this school, should make any citizen of this country seethe with anger. It does me. But you know, it is minimal to the seething anger I have over the fact that people really wont wake the ef up about this kind of thing, and bigger things that it almost certainly is a part of. And this kind of thing will not stop happening unless the bigger things are taken care of the way they need to be taken care of. The proverbial ‘head of the beast’ for lack of a better term.
      That’s what pisses me off MOST about this.
      This should have been a story about American citizens of that district getting word of this going on, and collectively getting together to stop this immediately. However much force it may take to do so.
      *note; I bet anything that if the citizen’s were to get together and do this, the ONLY injuries/casualties that would come is when the ‘military brigade’ leo’s came on-scene.(And of course, either not interested in hearing that they have a job to do to detain these traitors, from the very people they are supposed to take orders from..or..just opening fire/ tear gas/etc. and covering their asses later, when the ‘investigation’, that could take upwards of six weeks, is complete)*

      To try to be fair…maybe they are storing their energy for the coming fight?
      I doubt it, but trying to be fair. Their actions dictate otherwise, but I try to look at many sides of a story.
      There’s really no reasonable explanation to justify any person coming into this country to go to school. I agree with kids being educated, and wouldn’t want to detain from doing that..for ANY child really…but if it’s in this country, it should only educate those of this country…period.

      I dunno man…i just don’t know anymore.

        are not united anymore, how will honest to God
