Boise man angry with ACHD over driveway dispute

BOISE — A Boise resident claims he’s being bullied by the Ada County Highway District, and doesn’t understand why.  

It all revolves around a gated fence and driveway access in northwest Boise.

Wade Bantz says he has been using his back gate occasionally to drive trucks on to his property.

But ACHD says it’s an unauthorized driveway access.

It all started in May of 2013, when ACHD workers were sealing cracks in area and a spark ignited some bushes and nearby fence.

ACHD covered the cost for several vehicles that were burned and rebuilt the damaged fence, which included half of a gate.

Homeowner Wade Bantz said he thought the ordeal was over until he got a letter from ACHD.

It said he could no longer use this gate as a vehicle entry to his property.

“Yesterday, I received a cease and desist notice saying I can’t use this any longer,” said Bantz.

ACHD says Bantz started using the gate for his vehicles after it was replaced.

They says it’s an illegal use, an unauthorized driveway, and claim Bantz modified the access on the curb.

Bantz does have another, main driveway from the front side of his property.

He says his family has used this gate when needed, for years and doesn’t understand why he’s suddenly not allowed to.

“It’s always been here, always used it, I’ve owned this property eight years, my father owned it before then,” said Bantz.

But neighbors told us off camera, that’s not true. They say they noticed increased traffic through this gate after the fence was replaced.

Bantz says right now, he’s complying and won’t drive through the gate, but says the issue is bigger than his property.

“I feel like I’m being bullied, that’s the biggest thing probably for me, it really feels like they’re bullies, they’re the big dog in the valley so they get to set the rules,” said Bantz.

ACHD declined to comment for this story, but they tell us neighbors’ complaints led to their decision to send Bantz the cease and desist letter.
