DA confirms cop in wrong-way fatal crash had blood alcohol 3x legal limit

STATEN ISLAND — An official from the Staten Island District Attorney’s office confirmed Monday morning that the off-duty Linden cop who drove the wrong way on a Staten Island highway, crashing and killing two passengers, had a blood alcohol level three times the legal limit.

On Friday, NBC reported that unnamed sources told them Pedro Abad, 27, had a BAC of .24 percent; the legal limit is .08.

Today, Staten Island Chief Assistant District Attorney Daniel Master confirmed officially that Abad’s BAC was in fact .24 percent.  

Master could not say when and if charges would be filed against Abad, but said that his office “is not dragging their feet.”

“All I can say regarding timing on charges is that the defendant’s medical condition and the medical condition of any witnesses is a factor in the timing,” Master said.

On March 20, Abad struck a tractor-trailer head-on while driving the wrong way on the West Shore Expressway in Staten Island. Abad and fellow officer Patrik Kudlac, 23, remain in critical but stable condition with slow progress, Linden police have said. Officer Frank Viggiano and passenger Joseph Rodriguez, both 28, were killed in the crash. The NYPD confirmed the four men were at the Curves strip club before the crash and said they are investigating whether Abad was intoxicated.

Abad, a six-year veteran of the department currently earning a base salary of $92,416, was in a total of 8 accidents prior to the wrong-way crash, including two where he was charged with drunk driving.

NJ Advance Media uncovered that Abad was previously charged with DUI in crashes in 2011 and 2013, and was caught on a police dashcam unable to complete a sobriety test in the 2013 incident. The 2011 charges were dismissed when evidence was not turned over to Abad’s lawyer.

Abad’s lawyer in his previous DUI cases, Greggory Marootian, said Saturday that he is not currently representing Abad and does not practice law in New York.

The Middlesex County Prosecutor’s Office is investigating Abad’s driving and employment history.

  1. He killed 2 people ..while DUI

    so whats the sentence that would be given to anyone else of the same offence ? no special treatment should be seen for that cop because he should know better, if anything add another 5 years and a few more million to his bill <– his bill not ours

    Now THAT I can believe.

    They’ve got their best people searching for a way to justify this POS psycho pig’s actions.

    The only thing ‘dragging’ is the dispensation of justice.
