Police Wonder If They’ll Need To Confiscate Assault Weapons In Event Of Ban

CBS News

NEW YORK (CBSNewYork) — Amid talk of reinstating the assault weapons ban that expired eight years ago, police departments nationwide are thinking of ways to confiscate such weapons.

As WCBS 880’s Marla Diamond reported, among the departments considering taking action is the NYPD. Police Commissioner Ray Kelly said if Congress were to reinstate the ban, police are wondering whether it will be their responsibility to confiscate them.

WCBS 880′s Marla Diamond reports:

“I think that is a big, big question,” Kelly said. “Do you engage in a buyback?”

Kelly said the NYPD’s existing gun buyback has been successful.

“We’re up to about in two years, about 8500 weapons now, and that’s a significant number,” Kelly said.

But Kelly said with hundreds of millions of guns out there, buybacks are just one small part of curbing gun violence.

President Barack Obama and other lawmakers have come out in favor of re-implementing the assault weapons ban, as well as limits on the size of clips that can be used.

Mayor Michael Bloomberghas previously said the expiration of the ban has allowed weapons of war back onto the streets.

While Mayor Bloomberg said it is right for President Obama to console the grieving in Newtown, on the assault weapons ban he says it’s time for the president to stand up and lead.

Bloomberg noted that New York state has some of the toughest gun laws in the country and New York City has the lowest murder rate of any big American city.

Bloomberg is a long-time gun advocate who started “Mayors Against Guns,” which now has more than 700 members. He has been lobbying for:

  • Renewal of the assault weapon ban.
  • Required background checks for every gun sold right now — 40 percent of all guns are sold without background checks.
  • Stronger enforcement of straw sales, where someone buys a gun for someone not eligible to own one.
  • A requirement that states enter criminal and mental health records into the federal background check system.

The mayor said a shooting rampage like the one at Sandy Hook Elementary “only happens in America.”

Adam Lanza used a Bushmaster .223 assault rifle to kill 26 people inside the school, including 20 children. Police said Lanza did not use the two handguns he also had with him.

only in america? how about the massacre in newtown, tasmania which lead to the gun ban in australia?

    • chris says:

Things that make you go hmm…
There is historical precedence here, the time for rhetoric is coming for a close, given them an inch and they WILL take a mile.

On 28 April 1996, Martin Bryant, a troubled 28 year-old from New Town, Tasmania, took a Colt AR-15 semiautomatic rifle to the nearby tourist destination of Port Arthur. By the time he was arrested early the next day, he had killed 35 people and wounded 23. The reaction in Australia was profound, especially since it was a nation of gun lovers, target shooters and hunters.

The massacre provoked an immediate national debate over gun control. Strict laws were quickly put in place, banning semiautomatic weapons and placing serious controls on gun ownership. Since that time, there has not been one mass shooting in Australia.

Rebecca Peters took part in that debate. She is now an international arms control advocate, and led the campaign to reform Australia’s gun laws after the Port Arthur massacre. Days after the Newtown massacre, I asked Peters to explain how the gun laws changed in Australia in 1996:

“The new law banned semiautomatic rifles and shotguns, assault weapons, and not only new sales … we banned importation sales, we banned ownership, so currently owned weapons were prohibited. The government bought those guns back at a rate of about the retail price plus about 10%. You couldn’t get them repaired. You couldn’t sell them. It was a very comprehensive ban.

“The buyback ended up buying back and destroying more than about 650,000 of these weapons, which is the largest buyback and destruction program for guns anywhere in the world.”

I live in central Ky where nearly everyone has guns and yet tonight at the local Wallmart gun department I asked a clerk about sales and she said they were fast and furious! Obomination wants to take our guns away and my fellow citizens response is to get even more guns. This warms my heart and gives me hope for our country.

“Kelly said the NYPD’s existing gun buyback has been successful.

“We’re up to about in two years, about 8500 weapons now, and that’s a significant number,” Kelly said.”

    1. Everyone knows Kelly is Bloomberg’s henchman/right hand man.

    2. Why would anyone in their right mind believe that as many as 8500 weapons were actually turned in? Especially when it comes out of the mouth of Bloominidiot and his little puppy dog, Kelly.

8500? I call bullshit on that one. More like 85.

  4. European American says:

We know who owns NY City; it’s not America.

    Concerning America…
Imagine Police going door to door. No, Imagine SWAT teams going door to door. NO, imagine the Military going door to door. That’s the only way feasible, and that’s too “out there” to happen.

Twice this past week I went to a very big gun shop. It felt historic, both times. Like no bad guys were in there. Everyone knew what the mission was. Buy every gun and bullet cause this is WAR. With 30 minutes left before closing, one clerk came out and said “Anyone want a Colt AR15, these 5 are the last of 100 we had today.” They were grabbed but not fought over by those in the crowd. I went out feeling exhilarated and inspired, especially since now my small arsenal is complete. And I realized there is hope. If even a small percentage of gun owners rise up and make a statement, it will be awesome; a site to behold. Clearly, guns are the glue that holds this country together.

“A Police State and Armed Citizens cannot coexist.”

    • NC says:

I hope you’re right. For all our sakes.

    • US Marine Fighting Tyranny says:

      Hi European American,

Your description of what the crowd was like in that gun shop gives me a little hope,.. which I am grateful for because sometimes I feel like there are very few awake indeed!

As I stated on another article here,.. I am encouraged by people buying,… but it is people being, “willing to use” that will make the difference.

Right now, it is best to form into small groups, and get your organization and plans down, even if its just loosely developed tatics for one of several possible events that are coming,.. everything from economic collapse of the US,.. global collapse of the international banking system, some loosely constructed attempt at gun confiscation, a Bio False-Flag, a Nuclear False-Flag,.. another massacre to push the gun agenda (which I expect to occur), or a dozen or so other possible ways to kick this off.

One of the conversations you should have is, what will be your “red line”?

At what point, what kind of events or actions against you or friends/neigbors would need to transpire before you pull out a firearm, and aim it down range at a gov’t goon?

This is decisive to know, because once that happens,.. there is no going back.

In the eyes of our treasonous gov’t,.. you should not be allowed to “own firearms”, in addition they will be attempting to arrest you and anyone else involved, providing you survived any exchange.

This is no small matter to carefully consider, so I advise everyone to consider it well.

Good luck to all my fellow Patriots and loyal Americans.

“As I stated on another article here,.. I am encouraged by people buying,… but it is people being, “willing to use” that will make the difference.”

HI JD. Self preservation is the most powerful instinct man possesses.

Of all those guns now being sold, I have every confidence that 90 – 95% of them WILL be used against our traitorous enemies.

Especially once they cross the line for good, tip their hand, and there is NO doubt about their intentions.

      • NC says:

“As I stated on another article here,.. I am encouraged by people buying,… but it is people being, “willing to use” that will make the difference.”

That’s EXACTLY what I’m thinking, too, JD. Especially after watching Santa getting arrested in Austin, TX for chalking on a sidewalk with 30 people yelling at two police officers who could barely hold their own and letting them get away with it. What’s the point if you’re not going to do anything when the time comes? What’s the point of buying firearms if you are just going to turn them in when the time comes?

        • # 1 NWO Hatr says:

People being arrested is one thing, NC.

Once the blood starts to flow, I think we’ll see a SERIOUS attitude adjustment on the part of a great many people in this country.

      • Petunia Skrebbles says:

Good advice, just a reminder, Thomas Jefferson, I believe, said “On occasion, the garden of Liberty must be watered with the blood of patriots and tyrants”.

We are a creative and resiliant people and more technically advanced as a people than Afghanistan and they are whooping our butts over there. Why? guerilla warfare is why. How do you militarily fight a guerilla war as a standing army? I keep thinking about Ron Pauls 2008 campaign.

It was the best example of lassaiz faire decentralized, grassroots up achievement that anyone had ever seen. It even surprised Ron. No centralized organization, yet he beat them all, if the party had not violated all the laws they did to select McCain as the designated loser for the general election. Paul would have beat Obama.

That is why they had to violate fed and state laws to throw the primary to McCain. That speaks well for decentralized leaderless resistance.

I also believe that is why Rockefeller sent his Secretary of State, Henry Kissinger to Russia to reassure Putin that by Sept 2009, Americans would be under control and I think that is policy wonk talk for Guns confiscated. It didn’t happen and that is why we are still not in that world war they want and need.

I found out that the number of gun owning and carrying hunters in the US, outnumbers the entire military of both Russia and China together. That is impressive. The most recent figure I heard of the guns out here was 300,000,000. THEY GOT A PROBLEM, BIG TIME. LOL

        • Smilardog says:

Just counting registered “Deer Hunters” a year, average 19+ million and that is not counting any of the other hunting sports. Then there are millions more that don’t hunt at all, but can shoot the gnat off a bullfrogs a$$ at 400 ft.

  5. Fred says:

Hopefully the police will realize that trying to confiscate guns from
patriots will be a suicide mission..

  6. Greg Bacon says:

Is the term “Mayors Against Guns,” abbreviated to MAGS?

The PTB need a test case to see how well gun confiscation would go, and New York City would be an ideal place to test their freedom-smashing controls.

  7. austin says:

I know the constitution is irrelevant now, but has no ome in NY heard the terms ex post facto?

  8. michael mazur says:

Really ? On August 25 this year NYPD proved themselves incompetent to handle firearms.

In shooting dead a man who pointed a gun at them – he didn’t shoot, they also wounded downrange nine innocents, three directly, six by fragments.

If these bozos with guns are now allowed to enter people’s houses in search of assault rifles, Gawd help the kids and the missus, should the man, in abiding by the Constitution, choose to defend his 2nd Amendment right against this predation by the State.

  9. Peter Gozinya says:

Who is paying for all these grand schemes of mommygov? The country is broke so don’t worry about their tyrant wet dreams and just flood them with paperwork to hold it all up.

    • TranceAm says:

      They print the money themselves.
Just print a billion more for gun buy-back. Its not that in this stage of the game with the unlimited QE3(, 4 or 5 or where they hell they are.) of 4 billion a month to buy them mortgages (AND LAND they represent.), the amount of printed paper still counts.

And in a little while them dollahs won’t be worth the paper they are printed on….. Devlish scheme. And the law abiding suckers that did go along with the buy back were again fooled.

  10. Strawman says:

This brings up a very important issue that local police should be thinking about and asking themselves. When the Federal government issues the ‘confiscate’ order it will be up to local police on the front lines. This means your neighbors and maybe even friends will be the ones going door to door. We’ve all heard and possibly even said, “From my cold dead hands.” What will you do when your friendly local cop shows up? Won’t be some nameless, faceless, Fed holding out his hand at first. What are going to do then?

  11. chris says:

They will take your guns… if you let them.

I wish obama would just try to issue an executive order demanding gun confiscation. I don’t think it would be enforced and the ensuing political chaos would see him removed from office.

    O RLY?

Consider this: “On Sunday, 28 April 1996, at a sleepy little tourist location known as Port Arthur, something went down that will long live in memory of Australia’s collective psyche. An unknown professional combat shooter opened fire in the Broad Arrow Cafe at Port Arthur in Tasmania. In less than a minute 20 people lay dead, 19 of them killed with single shots to the head, fired from the right hip of the fast-moving shooter.

The awesome display of combat marksmanship was blamed on intellectually impaired Martin Bryant, who was held in illegal strict solitary confinement for more than 120 days, until he was “ready” to plead guilty. There was no trial. Within a matter of weeks legislation was passed to removed semi-automatic weapons from the Australian population and a gun buy-back proceeded. It is now illegal to own any semi-automatic gun in Australia.”
