The Staten Island district attorney is investigating the shocking death of a 400-pound asthmatic dad after a city cop placed him in a chokehold.

Eric Garner, 43, died Thursday after a sidewalk takedown by five NYPD officers making an arrest outside a Tompkinsville beauty parlor.

“My office is working along with the NYPD to do a complete and thorough investigation into the circumstances surrounding Mr. Garner’s death,” said District Attorney Daniel M. Donovan Jr. in a Friday statement.   

Police officials said Garner has a history of arrests for selling untaxed cigarettes.

The police Internal Affairs department began its investigation Thursday night, hours after the unarmed man’s death.

The NYPD, in its official statement about the fatal incident, said only that Garner went into cardiac arrest and died at Richmond University Medical Center. No criminal charges were filed Thursday in the death.

An NYPD spokesman would only say the man “was being placed in custody, went into cardiac arrest and died” at Richmond University Medical Center.
Within moments Garner, a married father of six children with two grandchildren, ceased struggling and appeared to become unconscious as police called paramedics to the scene.

But a video captured Garner’s desperate pleas for help as one cop shoved his head into the sidewalk and three others pinned him down — while a fifth cop put him in handcuffs.

“I can’t breathe! I can’t breathe!” he shouted in vain. By the video’s end, Garner was lying motionless on the sidewalk as cops chased eyewitnesses away.

Garner is the married father of six kids and grandfather to two. His outraged family said cops provided them with no details until they arrived at the hospital to identify the body.

Garner says on the video that he was breaking up a fight before cops arrived, and insisted that he was wrongly accused.

    dangerous. When someone says “I can’t breath” what is it that these
    morons don’t get? Are they machines and can’t process the info.
    Do they become rabid into the chase and lose all control? Must be
    one of the requirements for the job is to take a pro-psychotic pill.

  4. I don’t think I’ve ever seen such a clear cut case of intentional murder. Anybody can clearly hear him say he can’t breath. When you keep on choking him, then that’s homicide.

    McCullers was more fortunate than Eric Garner, an asthmatic street vendor who suffocated beneath a half-ton of privileged, state-subsidized suet after five NYPD officers threw him to the sidewalk.

    One of the assailants put Garner in a chokehold; he was quickly joined by several others who slammed the victim’s head repeatedly to the concrete.

    Following standard procedure, other officers provided a barricade to protect their comrades as they murdered Garner, who had six children and two grandchildren. One officer threatened a citizen who video-recorded the entire atrocity.

  9. When you walk up to some one and have no idea if they are the person you want,or if they did any thing wrong. You have a gun and lay a hand on them. That is attempted murder right there. They die at your hand that is murder. And yes they have the right once you touch them to deend themselfs from you a armed person. When are the cops going to learn to ask first as to what is going on? Oh they did! and they had a answer. I was not involved and don’t know. Unless others contradict that. You have no grounds for arest or to touch a person. You go of 1/2 cocked then plan on prison and being breach loaded there. This is why today no one will get close to a cop or speak to them. Why lay your life on the line around the likes of them? So they just walked up to a inocent person and asult with intent to kill for 5 and murder for 1 and 20 to life for all.
