California Gun Confiscation Bill Passes State Senate Committee

UPDATE: The bill has been slightly amended. The amendments make the bill ever so slightly not as bad as it was, but it’s still a terrible, unconstitutional bill that could result in the loss of gun rights for California citizens without due process. CAL-FFL has released a video (below) explaining the amendments.  

AB 1014, known as the gun violence restraining order bill, is quickly moving through the state legislature. The bill would allow authorities to confiscate guns from individuals who have this new type of restraining order taken out against them using no more than the word of a 3rd party.

According to KFBK,

In response to the recent streak of gun violence, the Senate Public Safety Committee has passed a bill that would temporarily take guns out of the hands of at-risk people.

Assemblymember Democrats Nancy Skinner, Das Williams and Senator Hannah-Beth Jackson say AB 1014 would give law enforcement the ability to obtain a Gun Violence Restraining Order to temporarily limit a person’s access to firearms when there are warning signs of violence.

The Los Angeles Times gives more details in an older report,

The measure, by Assemblyman Das Williams (D-Santa Barbara) and Assemblywoman Nancy Skinner (D-Berkeley), as well as state Sen. Hannah-Beth Jackson (D-Santa Barbara), would create a “gun violence restraining order,” using the same process that restraining orders are granted in cases of domestic violence.

Family members, partners and friends would have the ability to alert law enforcement if they believe someone poses a threat to themselves or others. Law enforcement officers would then be able to petition a judge to grant a restraining order that could prohibit possession or purchase of a gun.

Gun rights advocates are speaking out against the bill’s lack of due process and obvious potential for abuse,

“AB 1014 is a gun control nightmare,” said Brandon Combs, president of CAL-FFL. “California Democrats are taking their radical anti-gun agenda to an entirely new and horrifying level.” Combs, who debated the bill with Assemblymember Williams and UCLA Law Professor Adam Winkler on the Los Angeles-based radio talk show “Which Way, LA?”, said that the bill “guts due process” and the presumption of innocence.

“The subject of a restraining order and confiscation warrant may not even know they have been accused until there’s a SWAT team at their door.”

It’s not hard to see how this bill could easily be abused by anti-gun family members, friends, or even government agencies.

  1. Once the guns are confiscated from the individuals these “restraining orders” are filed against, they will never get them back. Officially of course the law will say you do – but they’ll put in place exhorbitant fees, taking safety classes, anger management or simply endless bureaucratic feedback loops to make it impossible for these persons to get their guns back. Kind of like they do with the elites not wanting poor people to be able to drive. Whenever they are pulled over, their vehicle gets impounded. By the time they get out of jail, the towing & impound fees are too much for them to pay – so they simply lose their cars.

    1. WELL, THEN THEY NEED TO GET THE GUNS ILLEGALLY LIKE EVERYONE ELSE DOES AND STASH THEM UNTIL THE PROPER TIME TO TAKE OUT THE SAME LEADERS WHO BROKE EVERY LAW IN THE CONSTITUTION AND ARE LAWLESS BUNCH OF WHORE PIMPS ANS PI MPETS.

    2. Unconstitutional LAW, by this illegal law. AB 1014 & taking guns from people they say are felons and mentally unstable, with out due process and paying for the property. Several State and Federal laws are being broken. This should be a good money maker for the citizens of Commie California.

  3. If this doesn’t work they’ll try something else next week, but you should expect them to endlessly invent cheap excuses to take people’s guns.

    What it comes down when you cut through the BS is that if you want to keep your guns, your home, your kids, your life, or any of your constitutional rights, you’re going to have to fight for them.

    The better prepared you are for the inevitable war, the better your chances of surviving it. End of story.

  5. It can easily be abused by government agencies. All they have to do is say that someone said that a person seemed violent, whether it is true or not, and then raid his home and take the gun. It can work for anything and since they always keep the informant’s identity a secret (for their protection of course), they can use this to get away with it at anytime.

  6. We are all familiar with the misuse of restraining orders, often by ex wives. And incidents of “swatting” are becoming more common…irresponsible and often downright evil individuals convince the police that some law abiding individual is “unstable” or somehow threatening, and girly men in black uniforms show up at his house with automatic weapons and body armor. This can and will lead to real tragedies.
    Here in California, all of us patriots are surrounded by mindless (and often heartless) leftists. We are all at risk of being “swatted” to death.
    Alexander Solzenitsin lamented that no one stood up to the KGB and resisted arrest with whatever makeshift weapons could be found. Had Jews been armed and ready to fight for their lives, the Nazi’s Holocaust plans would not have worked so well.
    When the fascists pound on our doors, will we meekly submit, only to repent at leisure in a torture cell or death camp? Or will we fight back, and perhaps live and even regain our former Republic? Will we die like sheep or fight like free men?
