KS State Secretary: “We will happily meet Mr. Holder in court” Over Gun Law

Kansas Secretary of State Kris Kobach has responded to Eric Holder and he is not backing down. Kobach warned, in a statement released Thursday, “With respect to any litigation, we will happily meet Mr. Holder in court.”

For the State of Kansas to pass the strongest 2nd Amendment legislation in the nation made my heart swell with American pride and their rejection of Mr. Eric Holder yesterday made me even prouder. I was born in Kansas and will die a “Jayhawk.” 

For those who don’t know… The Jayhawkers were “Free Staters” during the American Civil War. They would go into Missouri and “steal” slaves in order to ensure their God-given right to freedom. And so it is today. The proud people of Kansas value freedom that is a God-given right and they will not be intimidated by the likes of Attorney General Holder.

Last week Eric Holder sent a letter to Governor Sam Brownback informing the Governor that Kansas S.B. 102, The Second Amendment Protection Act, was unconstitutional. Here is a brief quote from the letter:

“In purporting to override federal law and to criminalize the official acts of federal officers, S.B. 102 directly conflicts with federal law and is therefore unconstitutional.”

Kris W. Kobach, Kansas Secretary of State, was quick to respond. Here is an excerpt from his official statement:

“On April 26, 2013, U.S. Attorney General Eric Holder sent a letter to Kansas Governor Brownback concerning SB 102, the Second Amendment Protection Act. In that letter, Holder declares SB 102 to be unconstitutional and suggests that federal officials will disregard it. Holder’s understanding of the United States Constitution is incorrect.

As one of the co-authors of SB 102 and a former professor of constitutional law, I ensured that it was drafted to withstand any legal challenge. SB 102 states that a firearm that is assembled in Kansas, that is stamped “Made in Kansas,” and that never leaves the State of Kansas is not subject to regulation by the federal government. It was drafted with the intent to assert Kansas’s authority as a co-equal sovereign under the United States Constitution to regulate a matter that is outside Congress’s jurisdiction under the Interstate Commerce Clause of Article I, Section 8. It was also drafted to stave off unconstitutional legislation pending in Congress that not only infringes upon the Second Amendment rights of Kansas Citizens, but also exceeds Congress’s constitutional power to regulate interstate commerce.”

I am attaching a copy of both letters at the end of the article for those who would like to read them in full. Eric Holder was just taken to school by a real constitutional scholar. The legislators in Kansas have shored up every loophole and this legislation should be a model for other states to follow.

Make no mistake Mr. Holder. If you send your people to Kansas in pursuit of any kind of unconstitutional gun grab they can and will be arrested. This is the law. You do not write laws in the State of Kansas.

This is not New York or California Mr. Holder. This is Kansas.

In Kansas we still cling to our God and our guns.

Jayhawks stand for freedom and will not back down at any cost. The stakes are too high.

    This has an explosive potential that could see the breakup of the union if the US government doesn’t see its error and the pitfalls ahead.

    If the government forces the issue here then it will blowback unpleasantly for them, it will also give massive traction to the secession movements in other states as this will interpret that democracy at a local level is worthless and that government edict overrides local laws and if a government decides to overrule a constitutional pillar of the law as it is being seen here the people are not going to tolerate it.

    Sooner or later it will come to the test, where the US govt sends in forces to quell state forces and to forcibly override state protestation, this is going to be own goal season for the govt when in reality it should be looking to back away from such confrontations.

        Yea, I think I’m slowly seeing that too, Cath. However, with the elite, you can never be too sure that this may be another part of their plan to destroy the U.S. We all know they definitely won’t give up without a fight. So let’s not get our hopes up or let our guard down just yet. It’s a good sign, but this war is far from over. Actually, the physical war may just be getting started.

    I am so sick of Washington trashing the constitution all in the name of “terror”.

    Homeland security didn’t do their job in Boston so what good are they – none.

    They need to be disbanded and dissolved and we need to use that money to get out of debt.

    I feel no safer today than I did on 9/10/2001 – In fact I probably feel less safe because of the bumbling idiots in Washington.

    The war could of been over in November of 2001 in Tora Bora if the idiots in Washington ran it like proud Americans instead of cowards and depended on locals to help get Osama.

    The middle management leaders of today’s society all need to go back to Harvard business economic school of business and stay there please and just talk among yourselves and leave the rest of us and the economy alone.

      “osama” has nothing to do with 911. Here is who positively did 911: the same crew who did the Vietnam fake gulf of tonkin “attack,” OKC and all of the FAKE “shootings” in the past decade, and the recent HOAX “Boston bombing: the cia and government traitors, along with mossad and isreal.

      NO planes were used on 911 – in fact a nuclear device and thermite blew up the 3 WTC towers. A cruise missile was fired into the pentagon from one of 6 pentagon underground defensive missile batteries, and the only thing that hit the ground in PA were dozens of fbi scum shovels enhancing the FAKE crash site, which had been there for years.

      I hope you investigate the truth about 911 in case you do not yet know.

      News flash suezz: The war was just getting started in Nov. 2001 – the ‘War on Terror’. You know, the one they wrote the Patriot Act for? The ‘war’ designed to strip us of our freedoms, and eventually our guns? The ‘war’ designed to make us hate those ‘Muslim terrorists’, and elicit sympathy for those Zionist AshkeNAZI Satanic so-called pukes, er…… I mean…. ‘jews’? THAT ‘war’ was inevitable, long planned.

      As to the second part of your comment, Osama bin Had WAS killed by a ‘local’ in 2001. His name was Omar Sheik.

      The deceptively named “war on terror” was created as an excuse to wage war on Americans, not just as an excuse to invade foreign lands with large oil reserves, opium, and other valuable resources some mega rich criminals want to steal. Our so-called “government” has been carrying out terrorist attacks on American citizens for decades now, in order to justify these resource wars and draconian police state “laws” whose primary purpose is destroying our constitution and Bill of Rights.

      Google the words ‘Emad Salem, World Trade Center bombing’ for an education on how this works.

      Our “government” in Washington isn’t trying to disarm us in order to “keep the children safe”. They’re doing it in order to try to prevent us from arresting the whole bunch of them for treason.
